Reporting and Addressing Complaints

Reporting Sexual Harassment

If you experience or witness sexual harassment, it is important to report the incident immediately to help maintain a safe, respectful, and inclusive workplace. Timely reporting allows the organization to take appropriate action and protect everyone involved.

Immediate Action: If you feel safe and comfortable, firmly inform the individual that their behavior is unwelcome, inappropriate, and must stop.

Document the Incident: Record all relevant details, including the date, time, location, description of the incident, and the names of any witnesses.

Report to the Internal Committee (IC): Submit a formal complaint to the Internal Committee through the organization’s approved channels, such as email, an online portal, or an in-person submission, for a fair and confidential review.

Internal Committee (IC) Process

The Internal Committee (IC) is responsible for receiving, investigating, and resolving complaints of sexual harassment in a fair, impartial, and confidential manner. The process includes the following steps:

Receiving the Complaint: Upon receiving a complaint, the IC acknowledges it in writing and initiates the required procedure.

Preliminary Assessment: The IC reviews the complaint to determine whether it falls within the scope of sexual harassment under the POSH policy.

Formal Investigation: If the complaint is found to be valid, the IC conducts a detailed inquiry by interviewing the complainant, respondent, and relevant witnesses while examining all available evidence.

Maintaining Confidentiality: The IC ensures complete confidentiality throughout the inquiry.

Support Systems Available

Providing timely support to individuals who experience sexual harassment is essential to ensure their well-being and help them recover with confidence. The following support systems are available:

Counseling Services: Access to professional counselors who provide emotional support, guidance, and assistance in managing the psychological impact of harassment.

Legal Assistance: Information and guidance on legal rights, available remedies, and support in filing complaints with the appropriate legal authorities, where required.

Employee Assistance Programs (EAPs): Confidential programs that offer counseling, emotional support, professional advice, and other wellness services to help employees deal with workplace challenges while protecting their privacy.

Law of Prevention of Sexual Harassment At Workplaces.

Be it Private organization, public sector companies, Government bodies OR corporate companies, if any employer having more than 10 employees in his organization, it is mandatory to constitute an INTERNAL COMMITTEE within the company to handle the sexual Harassment complaints. If this law is not complied by the organization, Penalty provision of cancellation of business license is there. As a Lawyer we suggest you to follow this law not because of penalty but Sexual Harassment free environment lead to good business growth.

Constitution of Internal Committee

A group of four member includes a senior level woman employee of the organization, two other employee member from same organization and one external women member preferable a female lawyer who are familiar with the issues relating to sexual harassment and other women legal issues. As per the law at least 50% member of internal committee should be women.
